【泰國勞動】勞工非自願性離職遣散費是否依年資累加?

這波持續性的疫情在東南亞無一倖免,在泰國也是動不動就是上萬例,公司也在討論針對泰國地區的同仁進行資遣方案討論,下面就泰國勞工保護法規定,跟大家分享~

目前依據泰國法令2021年7月13日的內閣會議通過COVID-19的補助措施,因應根據第 27 號緊急命令第 9條發布的關閉營業場所的命令而導致的封城,所受影響的雇主才可以不依照泰國勞工保護法的規定給付員工資遣費,其餘的狀況都是需要給付資遣費的。

而法規中2019年勞工保護條例(Thailand’s Labour Protection Act (No.7)修正原勞動法(Labour Protection Act of 1998),給付員工的資遣費是會依照員工的工作年資累加。

參照1998年勞動條例第118條後段(Labour Protection Act of 1998)提到有關解雇賠償的給付應該屬於雇主不願意員工繼續工作且不給付員工薪資情形,所以雖然是因為COVID-19導致雇主無力經營,但只要不是因為被政府通知停業者。都需要給付員工資遣費。

第118條後段

Termination of employment under this Section means any action by which an
employer does not allow the employee to continue to do work and does not pay wages to the employee, regardless of whether the cause is the cessation of the employment agreement or another cause, and the meaning also covers cases where an employee does not do work and is not paid wages because an employer is unable to continue business operations.此法律所指的「解雇」意指:雇主不讓員工繼續工作且不再發放工資。理由可為:勞雇合約期滿或其它原因,包括雇主無力經營使員工失業及領不到工資。

Section 118. An employer shall pay compensation to an employee whose
employment has been terminated as follows:
第一一八條:雇主須按照下列原則支付資遣費給被解雇的員工。

1.An employee who has worked consecutively for a full one hundred and twenty days but less than one full year shall be paid not less than thirty days the last wage rate or not less than the wages for the last thirty days of work in respect of an employee who is paid a wage on a piece work basis.
雇主需支付已連續工作 120 天但不足 1 年的員工的資遣費不少於最後 30
天的工資。計件員工則須支付不少於最後 30 個工作天的工資。
2.An employee who has worked consecutively for one full year but not a full
three years shall be paid at least an amount equivalent to ninety days’ pay at
his or her most recent wage rate or not less than the wages earned for the last
ninety days of work in respect of an employee who is paid a wage on te basis
of piece work.
雇主需支付已連續工作滿 1 年但不足 3 年員工不少於最後 90 天的工資。
計件員工則須支付不少於最後 90 個工作天的工資。
3.An employee who has worked consecutively for a full three years but not a
full six years shall be paid an amount at least equivalent to one hundred and eighty days’ pay at his or her most recent wage rate, or not less than the wages
earned for the last one hundred and eighty days of work in respect of an
employee who is paid a wage on the basis of piece work.
雇主需支付連續工作滿 3 年但不足 6 年員工不少於最後 180 天的工資。計
件員工則須支付最後 180 個工作天的工資。
4.An employee who has worked consecutively for a full six years but not a full
ten years shall be paid an amount equivalent to at least two hundred and forty
days’ pay at his or her most recent wage rate or not less than the wages earned
for the last two hundred and forty days of work in respect of an employee who
is paid a wage on the basis of piece work.
雇主需支付已連續工作滿6年但不足10年員工不少於最後240天的工資。
計件員工須支付不少於最後 240 工作天的工資。
5.An employee who has worked consecutively for a ten full years or more shall
be paid an amount equivalent to at least three hundred days at his or her most
recent wage rate, or not less than the wages for the last three hundred days of
work in respect of an employee who is paid a wage on the basis of piece work.
雇主需支付工作超過 10 員工不少於最後 300 工作天的工資。計件員工則
支付不少於最後 300 工作天的工資。
