【台越大不同】鮭魚之越南姓名權

台灣這兩天很瞎的鮭魚之亂本來小編一直以為是P圖的,為了行銷聲量所以P圖,然後好笑而已,沒想到是真的改。

而且竟然上了新聞【Đổ xô đổi tên thành ‘Cá hồi’ để ăn sushi miễn phí】小編是看了很多越南的粉專都轉貼了這個新聞,但這裡沒有任何行銷活動可以跟風,不過小編想來討論越南姓名權。

參照越南民事法規(91/2015/QH13)第28條規定要改名必須有幾個條件必須符合下列條件之一

1.名字產生混淆,影響到家庭、感情本人及合法權益==>類似我們的名字字義粗俗不雅

2.根據養父母要求變更或收養關係結束

3.確認了生父母

4.流浪的人找到自己的名字

5.因涉外婚姻改名或因涉外婚姻結束重新變回

6.重新認定性別或變性人的名稱修改

7.戶籍相關法律所規定的其他情況

這樣看起來只有去找戶籍法,小編去找了123/2015/ND-CP ON GUIDELINES FOR LAW ON CIVIL STATUS也沒有寫可以改名的其他狀況,只有寫了改名18歲以下要父母同意。沒有法律說可以改幾次或可不可以隨便改名。

但有個很特別的規定依民事法雖然18歲以下改名要父母申請,但9歲以上就要經本人同意,所以9歲以上的小朋友要改名本人也是有同意權的喔!小編國小畢業也有被爸媽改過名,但沒有徵得我的同意呀!!!!小編記得小時候還難過的哭了好久,而在台灣未成年人第二次改名,應於成年後始得為之。(但小編現在也不想再改回原來的名字了!!!)

另外,改名的事由裡針對如果是重新定義性別也可以在改名的申請事由裡,小編覺得很先進~

但上面那則鮭魚紅到越南的新聞,小編在下面看到留言寫一群貪婪的人,想想覺得有點丟臉,不過也有人說台灣怎麼行政效率這麼高!!!!

91/2015/QH13 CIVIL CODE

Article 28. Right to change given names

1. An individual has the right to request a competent authority to recognize the change of a given name in any of the following cases:

a) Where it is so requested by the person who has a given name which causes confusion or has an adverse effect on his/her feelings or on his/her honor, legitimate rights and interests;

c) Where the adoptive father or mother of the person wishes to change the given name of their adopted child; of if a person ceases to be an adopted child and such person or his/her biological father or mother request to reclaim the given name which is given by the biological father or mother;

d) Changing the given name of a person whose biological parents have been identified upon the request on that father or mother or such person;

dd) Changing the given name of a lost person who has discovered the origin of his/her bloodline;

dd) Change the given name of a person to his/her spouse’s in the marriage and family relations involving foreign elements in accordance with law of the country in which the foreign spouse is a citizen retrieves his/her family name before the change;

e) Changing of given name of a person whose gender identity is re-determined or a transgender person;

g) Other cases prescribed in by law on civil status affairs.

2. The changing of the given name of a person who is nine years of age or older shall be subject to the consent of such person.

3. The changing of a given name shall not change or terminate the civil rights and obligations which were established in the former given name.

123/2015/ND-CP ON GUIDELINES FOR LAW ON CIVIL STATUS

Article 7. Conditions for changes and correction of civil status affairs

1. An application for change of full name of a person less than 18 years of age prescribed in Clause 1 Article 26 of the Law on civil status shall be subject to his/her parents’ consent which is specified in such application. An application for change of full name of a person aged 9 or older shall also be subject to his/her consent.

2. Civil status correction prescribed in the Law on civil status means correction of personal information in vital records or originals of civil status documents which have been carried out only when there are substantial grounds to prove presence of mistakes at the civil status official’s faults or at the applicant’s faults.
